Shipping to Italy:
Throughout Italy, shipping is free of charge for orders over 35 €, for lower amounts the shipping cost is 5.50 €.

The purchased goods are dispatched on the same working day as the order is placed if the order and payment are received by 3pm.
If you decide to pay by cash on delivery, the shipment will take place on the same working day as the order if received by 3 p.m.
Delivery will take place within 24/48 depending on whether the area is served daily or not and whether delivery is to Sardinia or Sicily.
On the same evening of the day the order was paid for, the courier will send the customer an e-mail with the details and tracking of the shipment.
The service is managed automatically and autonomously by the courier.

GENERAL TERMS AND CONDITIONS OF SALE

Art. 1 - General Provisions

1. By navigating in this area, the user accesses "E-Commerce Polideas", accessible through the url: https://www.polideas.it/. Browsing and transmitting a purchase order on the site implies acceptance of the Conditions and Data Protection Policies adopted by the site indicated therein.

2. These General Terms and Conditions of Sale apply to the sale of products with exclusive reference to purchases made on the website in accordance with the provisions of Part III, Title III, Chapter I, Consumer Code (Legislative Decree no. 206/05 amended by Legislative Decree no. 21/14 and Legislative Decree no. 70/03) by

3. The user is obliged, before accessing the products provided by the site, to read these General Terms and Conditions of Sale, which are generally and unequivocally accepted at the time of purchase.

4. The user is invited to download and print out a copy of the purchase form and these General Terms and Conditions of Sale, the terms of which 'E-Commerce Polideas' reserves the right to modify unilaterally and without prior notice.

Art. 2 - Object

1. These General Sales Conditions regulate the offer, forwarding and acceptance of purchase orders for products on "Polideas E-Commerce" and do not regulate, on the other hand, the supply of services or the sale of products by subjects other than the seller who are present on the same site through links, banners or other hypertext links.

2. Before placing orders and purchasing products and services from other parties, we suggest you check their terms and conditions of sale.

Art. 3 - Conclusion of the Contract

1. In order to conclude the purchase contract, it will be necessary to complete the form in electronic format and submit it following the relevant instructions.

2. It contains a cross-reference to the General Terms and Conditions of Sale, images of each product and its price, the means of payment that can be used, the method of delivery of the purchased products and the related shipping and delivery costs, a cross-reference to the conditions for exercising the right of withdrawal, and the method and timing for returning the purchased products.

3. Before concluding the contract, you will be asked to confirm that you have read the General Terms and Conditions of Sale including the Information on the right of withdrawal and the processing of personal data.

4. The contract is concluded when the seller receives the form filled in by the user, after verification of the correctness of the data contained therein.

5. The purchaser will be obliged to pay the price from the moment the online order procedure is completed. This will be done by clicking on the "MAKE ORDER" button at the end of the guided procedure.

6. Once the contract is concluded, the seller takes over the order for processing.

Article 4 - Registered Users

1. In completing the registration procedures, the user undertakes to follow the instructions on the site and to provide his/her personal data correctly and truthfully.

2. Once registration has been completed, the user will receive a confirmation e-mail in the e-mail provided by him/her. The confirmation must be communicated within a maximum of 48 hours. After this period, in the absence of confirmation, "E-Commerce Polideas" will be released from any commitment to the user.

3. The confirmation will in any case exonerate "E-Commerce Polideas" from any responsibility regarding the data provided by the user. The user is obliged to promptly inform "E-Commerce Polideas" of any variation of their data communicated at any time.

4. If the user then communicates inaccurate or incomplete data, or even if there is a dispute by the parties concerned regarding the payments made, "E-Commerce Polideas" shall have the right not to activate or to suspend the service until the relevant shortcomings have been remedied.

5. At the time of the first request for activation of a profile by the user, "E-Commerce Polideas" will attribute to the same a user name and a password. The latter acknowledges that these identifiers constitute the validation system for the user's access to the Services and the only system capable of identifying the user, and that the acts performed through such access will be attributed to him/her and will be binding on him/her.

6. The user undertakes to keep his access data secret and to guard them with due care and diligence and not to pass them on, even temporarily, to third parties.

Art. 5 - Availability of Products

1. Product availability refers to the actual availability at the time the purchaser places the order. However, this availability must be considered purely indicative because, due to the simultaneous presence of several users on the site, products may be sold to other customers before the order is confirmed.

2. Even after the order confirmation e-mail has been sent, partial or total unavailability of goods may occur. In this eventuality, the order shall be rectified automatically by deleting the unavailable product and the purchaser shall be informed immediately by e-mail.

3. If the buyer requests the cancellation of the order, terminating the contract, "E-Commerce Polideas" will reimburse the amount paid within 30 days of "E-Commerce Polideas" becoming aware of the buyer's decision to terminate the contract.

Art. 6 - Products Offered

Art. 7 - Terms of Payment and Prices

1. The price of the products shall be that indicated on the site from time to time, except where there is an obvious error.

2. In the case of an error, "E-Commerce Polideas" will notify the buyer as soon as possible, allowing the order to be confirmed at the correct amount or cancelled. In any case, there is no obligation for "E-Commerce Polideas" to supply what is sold at the lower price erroneously indicated.

3. Site prices include VAT and do not include shipping costs. Prices may change at any time. Changes do not affect orders for which an order confirmation has already been sent.

4. Once you have selected the desired products, they will be added to your shopping cart. Simply follow the purchase instructions, entering or verifying the required information at each step of the process. Order details can be changed before payment.

5. Payment can be made by:

Credit Card (VISA, Mastercard, NEXI, V-Pay); Cash on Delivery; PayPal; Bank Transfer.

Art. 8 - Delivery

1. 'E-Commerce Polideas' delivers to the whole of Italy, excluding the Vatican City State and the Republic of San Marino.

2. 'Polideas E-Commerce' will only make deliveries to the user's home, provided at the time of purchase.

3. Delivery is made, for the Italian territory, generally within 1-2 working days, or, if no delivery date is specified, within the term estimated at the time of selection of the delivery method and, in any event, within a maximum term of thirty days from the date of confirmation.

4. For countries within the European Union, delivery will be made in 4-5 working days, and in any case, within the maximum period of thirty days.

5. If delivery is not possible, the order shall be sent to the warehouse. In that event, a notice will specify the location of the order and how to agree on a new delivery.

6. If you are unable to be present at the delivery location at the agreed time, please contact us again to agree on a new delivery date.

7. If delivery cannot take place for reasons not attributable to us after thirty days from the date on which the order is available for delivery, we shall assume that we are terminating the contract.

8. As a consequence of termination, the amounts shall be returned, including the costs of delivery to the exclusion of any additional costs resulting from the choice of a delivery method other than the ordinary method offered without undue delay and, in any event, within 30 days from the date of termination of the contract. Transport resulting from the termination of the contract may have additional costs that shall be borne by the purchaser.

9. Shipping costs shall be borne by the purchaser and are explicitly highlighted when placing the order.

Article 9 - Passing of Risk

1. The risks relating to the products shall pass to the purchaser from the moment of delivery. Ownership of the products shall be deemed to have been acquired upon receipt of full payment of all amounts due in respect thereof, including shipping costs, or at the time of delivery, whichever occurs later.

Article 10 - Warranty and Commercial Conformity

1. The seller is liable for any defect in the products offered on the site, including non-conformity of the items to the products ordered, pursuant to the provisions of Italian law.

2. If the purchaser has entered into the contract as a consumer, i.e. any natural person acting on the site for purposes outside his or her trade or profession, this guarantee shall be valid provided that the defect manifests itself within 24 months from the date of delivery of the products; that the purchaser submits a formal complaint regarding the defect within a maximum of 2 months from the date on which the defect was recognised by the purchaser; and that the online return form is filled in correctly.

3. In the event of non-conformity, the purchaser who has entered into the contract as a consumer shall be entitled to have the goods restored to conformity free of charge by repair or replacement, or to obtain an appropriate price reduction, or to have the contract rescinded in respect of the disputed goods and the price refunded accordingly.

Article 11 - Withdrawal

1. In accordance with the legal provisions in force, the purchaser has the right to withdraw from the purchase without any penalty and without specifying the reason, within the term of 14 days pursuant to Article 57 of Legislative Decree 206/2005 commencing from the date of receipt of the products.

2. In the case of multiple purchases made by the purchaser in a single order and delivered separately, the 30-day period begins on the date of receipt of the last product.

3. If the user wishes to exercise the right to cancel the purchase, he may send an e-mail, indicating the order number and user name, to:

4. The purchaser shall also exercise the right of withdrawal by sending any express declaration containing the decision to withdraw from the contract or alternatively by sending the standard withdrawal form, as set out in Annex I, Part B, Legislative Decree 21/2014, which is not mandatory.

6. The goods must be returned undamaged, in their original packaging, complete in all their parts and complete with the attached tax documentation. Without prejudice to the right to verify compliance with the above, the site will refund the amount of the products subject to withdrawal within a maximum period of 14 days, including any shipping costs.

8. The right of withdrawal shall not apply in the event that the services and products of 'E-Commerce Polideas' are included in the categories of Article 59 of Legislative Decree 206/2005.

9. The site will make the refund using the same means of payment chosen by the purchaser at the time of purchase. In the case of payment by bank transfer, and if the purchaser intends to exercise his or her right of withdrawal, he or she shall provide the bank details: IBAN, SWIFT and BIC necessary for the refund to be made.

Article 12 - Data processing

1. By using the website, the user authorises the processing of his or her personal data. This information is also valid for the purposes of Article 13 of EU Regulation No. 2016/679 on the protection of individuals with regard to the processing of personal data and on the free movement of such data.

5. Data is processed exclusively in electronic form, using IT tools and media designed to ensure the security and confidentiality of the data. The stored information is protected against unauthorised access.

6. We process data provided by users regarding purchase orders, payments (which may contain name, address, contact details), IP address, all other data communicated.

7. The purpose of the use of such data is the execution of the purchase order and payments, the communication of such data to third party providers of payment and shipping services as well as contacts of an informative nature regarding the activities and services of the site, offers of a commercial nature from affiliated companies and business partners.

8. The provision of data and consent to the processing of data for the purposes of the purpose of the contract, i.e. the execution of the order and the related payment, is necessary for the conclusion and execution of the contract, and therefore the refusal to provide such data or to consent to its processing makes it impossible for the user to purchase the products and services on offer.

9. The provision of data and consent to its processing for the purposes of commercial communications is optional. However, any refusal to provide such data or to consent to its processing may result in the impossibility for the user to receive such further services.

10. You always have the right to have your data updated, corrected or supplemented, to have your data deleted, made anonymous or blocked if processed in breach of the law, including data whose storage is not necessary for the purposes for which the data were collected or subsequently processed, certification to the effect that the operations have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected.

11. You have the right to object, in whole or in part, to the processing of personal data concerning you for legitimate reasons, even if pertinent to the purpose of collection, and to the processing of personal data concerning you for the purpose of sending advertising or direct sales material or for carrying out market research or commercial communication.

12. The user may also revoke at any time the consent to the processing of his or her data previously given to 'E-Commerce Polideas'.

13. All rights under EU Regulation 2016/679 may be exercised by the user by writing to the following email: info@polideas.it.

14. On the first visit, the user will be invited to choose his language and will be offered the possibility of saving his preferred language. To this end, the user authorises the use of identification codes known as cookies, i.e. small files sent by its Internet server and recorded on the hard disk of the user's computer.

15. The hard drive collects information about the user's language preference and stores the pages of the site visited. Cookies are used to prevent the user from receiving the same information repeatedly or in the wrong language, and to adapt the content and presentation of the site to the user's browser type.

Art. 13 - Safeguard Clause

1. Should one of the provisions of these General Terms and Conditions of Sale be invalid for any reason whatsoever, this shall in no way affect the validity of and compliance with the other provisions of these General Terms and Conditions of Sale.

Article 14 - Processing of personal data

In accordance with the provisions of EU Regulation 2016/679 on the protection of personal data, and in particular Article 13 thereof, POLIPLAST S.r.l. hereby provides the Customer with the following information:

i) The holder of the collection and processing of personal data is the company POLIPLAST S.r.l. (hereinafter referred to only as the "Company") with registered office in Ormelle (TV), via Roma 118, enrolled in the Register of Companies of Treviso - Belluno, VAT no. 01221360264, to which the Customer may send any request to the company's registered office by addressing it specifically to the Administration Office, or by e-mail to the following address info@poliplast.net.
ii) The Company informs that the processing of the Customer's personal data will be carried out for the purposes set out below:
[a] allow the Customer access to the part of the Company's Website dedicated to online sales of its Products and consequently allow the Customer to carry out all purchase procedures, as well as to allow the Supplier to carry out all the various administrative, commercial, accounting and tax activities deriving from online sales, and more generally, to execute the existing legal obligations in this regard;
[b] make known to the Customer, by sending advertising and informative material by means of periodical e-mails, information concerning the Company's products and services as well as any further initiatives, commercial or otherwise, undertaken by the Company.
iii) The Company undertakes to treat the data and information transmitted by the Customer with confidentiality and not to disclose them to unauthorised persons, nor to use them for purposes other than those for which they were collected or to transmit them to third parties other than those indicated below. Personal data may only be communicated to parties delegated to carry out the activities necessary to fulfil the contractual commitments undertaken by the Supplier and the Customer (e.g. credit institutions, transport and shipping companies, external structures that collaborate directly with the Supplier in the technical and informative management of the Website). Furthermore, the Company's personnel assigned to the delivery and shipment of the Products, the personnel assigned to the management of the Internet Site and the personnel dedicated to the performance of marketing activities may also become aware of the data.
iv) The Company informs that it carries out profiling of its customers through the user's purchase history.
v) The data acquired will be kept for a period of time no longer than is necessary for the purposes for which they were collected or subsequently processed and in compliance with the prescriptive terms imposed by law. In the case of data processed for marketing purposes (purposes under letter [b] above), the processing shall be carried out until the Customer exercises the revocation referred to under letter [vi] below, with the consequent deletion of his/her data from the mailing list on which they were included.
(vi) The Customer enjoys the rights set out in Article 15 et seq. of EU Regulation 2016/679, including the right to request access to and rectification or erasure of personal data or restriction of processing concerning him or her, or to object to their processing.
vii) With reference, however, to the processing of personal data for the purpose referred to in [b] above, the Customer shall always have the right to revoke the consent given for that purpose, in particular by following the procedure for unsubscribing from the mailing list on which the Customer's data have been included following the consent given by the latter.
viii) The Customer also has the right to lodge a complaint with the relevant supervisory authority, Garante per la protezione dei dati personali.
ix) The disclosure of the Customer's personal data is a contractual obligation, as it is a necessary requirement for the online purchase of the Company's Products. Failing this, the Customer will not be granted this possibility, nor will the Customer be able to make purchases using the procedures provided on the Company's website. With reference, on the other hand, to the marketing activities (purposes referred to in letter [b] above) carried out by the Company, failure to provide the data and/or failure to consent to their processing will not allow the sending of advertising and informative material as outlined above.
x) Data will not be transferred outside the European Union

Art. 16 - Applicable Law and Jurisdiction

1. These General Terms and Conditions of Sale shall be governed by and construed in accordance with the laws of Italy, without prejudice to any other overriding mandatory rules of the purchaser's country of habitual residence. Accordingly, the interpretation, execution and termination of the General Terms and Conditions of Sale shall be subject exclusively to Italian law.

2. Any disputes arising out of and/or in connection with the same shall be settled exclusively by the Italian courts. In particular, if the purchaser has the status of Consumer, any disputes shall be settled by the court of the place of domicile or residence of the same in accordance with the applicable law.
